I believe there are certain exceptions under the Equalities Act.
Historically clubs have always had regard for the age of their squads- for years Chelsea had a policy of only giving 1 year extensions to over 30 players.
As I said Simon, I'm not a lawyer and I know there are exceptions under the equalities but I very much doubt this would be one as Tom Nichols has plenty of evidence (from us) that he was capable of performing the tasks assigned to him as well as the fact that another employer clearly believes he is capable.
It was meant to be a throw away remark though...a bit of a stir if you will and the thought of a Tom taking this to court is absurd but the remarks are clearly ageist.
Given the various shenanigans that have gone on since the WAGMI show rolled into town, accusations of “ageism” are just one more bump in the road. FWIW my understanding is that WAGMI told Betsy he had to get rid of GM. They aren’t keen on experience or talent WAGMI. Both are irrelevant.
If there is a clause in Balcombe's loan agreement that insists he must play when fit, then I would much rather have the experienced Glenn Morris as a back up 'keeper than Addai.
Imagine Balcombe picking up a serious injury with eight "must win" games to go to ensure our EFL status and we have Addai as the number two.

That makes sense - I think Addai has great potential, but needs to play to progress. Balcombe is fine so far as I’m concerned - as good a shot-stopper as Morris, probably better in the air, about the same as Morris kicking-wise.
Glenn left CTFC because he didn't want to be a bench warmer.
Apparently he had a two year contract with CTFC when Balcombe and Addai were signed.
I don't know why we didn't just stick with Glenn and use the money on outfield players.
It's WAGMI economics. Get 3 new keepers in when you have one of the league's best keepers. Alienate the senior players and get in a bunch of inexperienced players and sell one of your best players mid season to a relegation rival bc 29 is 'too old' and Nichols is 'too small' and 'too similar to Telford'. Get rid of 2 managers and not give the job to a caretaker manager who was doing a good job because we were outshot by opponents despite our most successful run of the season and then hire a manager and then both parties decide it's not a good fit a few weeks later.

In terms of the football side of things, surely the average fan could've done a better job by simply delegating the role to experienced football people not some random stats geezer that's never run a lower league club before.
